Please read these Terms of Service carefully before using Tabeku. By creating an account or using our application, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and the "Tabeku Team" (the developer). If you do not agree to these terms, you must not access or use the Tabeku app or website.
2. Service Description
Tabeku is a nutritional tracking platform that helps users log meals, plan nutrition, and analyze food using artificial intelligence (AI). The service is available as a web app and may be offered as a mobile application. Features may be added, modified, or removed at our discretion, particularly as we are actively improving the platform.
3. Eligibility & User Accounts
You must be at least 16 years old to use Tabeku. You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may only create one account per person.
4. Free and PRO Subscriptions
Tabeku offers both a free tier and a PRO subscription providing access to advanced features (like unlimited AI analysis). PRO subscriptions are billed automatically according to the cycle you select. Subscriptions are managed directly through the Apple App Store, Google Play, or our designated payment processor (RevenueCat). Pricing is subject to change with prior notice. Cancellations must be made through the respective platform's subscription management settings.
5. Acceptable Use
You agree not to: a) use the service for illegal purposes; b) attempt to reverse-engineer, decompile, or extract the source code or AI systems; c) use automated means (scraping, bots, API abuse) to access data; d) upload harmful, explicit, or malicious content; or e) share your account access with third parties. We reserve the right to suspend or terminate accounts that violate these restrictions immediately and without notice.
6. User Content & License
You retain ownership of any data, text, or photos ("User Content") you submit. By submitting User Content, you grant Tabeku a worldwide, non-exclusive, royalty-free license to use, process, and display that content solely for the purpose of providing the service to you. We are not obligated to backup your data; you should maintain your own records if necessary.
7. Intellectual Property
All content, design, trademarks, software, and functionality of Tabeku (excluding User Content) are owned by us and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. AI-Generated Content Disclaimer
Our AI features estimate nutritional values based on your inputs. These are approximations and may not be 100% accurate due to lighting, portion sizes, or complex recipes. AI outputs do not constitute professional dietary advice. You must verify critical nutritional information independently.
9. Medical & Health Disclaimer
Tabeku is NOT a medical device. We do not provide medical advice, diagnosis, or treatment. The app is for informational and general wellness purposes only. Always consult a qualified healthcare professional or registered dietitian before starting a new diet, especially if you have underlying health conditions, allergies, or eating disorders.
10. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABEKU EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE TABEKU TEAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Tabeku Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party right.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of Tabeku shall be subject to the exclusive jurisdiction of the courts located in Spain. 14. Changes to Terms & General Provisions
We may update these terms periodically. Continued use of the service after notice of changes constitutes your acceptance. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision will not be considered a waiver of those rights.
